Rental terms and conditions

Occupancy of rented premises

The tenant will enjoy the entirety of the rented premises and furniture. The rental is granted for a stay that will begin and end on the days and dates indicated. The tenant signatory of this contract, will not be able under any circumstances to avail himself of any right to remain in the premises at the end of the rental period. The rental concluded between the parties to this contract can not benefit third parties, unless agreed beforehand by the owner. The tenant is required to report any interruption in the operation of the services. He must ensure the peaceful nature of the rental and make use of it in accordance with the agreed contract. He agrees to take possession of the premises on the dates and times stipulated in the contract.

Number of tenants

If the number of tenants exceeds the capacity indicated in the contract and without prior agreement, the owner reserves the right to terminate the contract or receive an increase on the rental fees.

Payment

The reservation becomes effective as soon as the tenant has sent the owner, a deposit of 25% of the rental amount, a copy of the signed contract and a holiday insurance certificate. The balance of the rental will be paid 30 days before entering the premises by bank transfer. If the balance of the rental is not paid no later than 30 days before the arrival date stipulated on the contract, the agency reserves the right to cancel the stay. In this case, the deposit will be returned to the tenant if and only if the accomodation concerned is rented at the same period and at the same rate. In the event that the reservation is made within a period of less than 30 days from the date of arrival, the tenant will pay the total amount of the rental in one installement.

Cancellation

Any cancellation must be notified by registered letter and duly justified (see conditions below) :

If cancellation more than 30 days before the arrival of the tenant : the deposit paid will remain with the owner. It will be returned only if the rental can be re-rented for the same price at the same period.

If cancellation less than 30 days before the date of entry of the tenant, the entire amount of the rental will be acquired by the owner according to the terms of payment.

EXCEPT AS DESCRIBED BELOW :

1/ Cancellation in case of force majeure:

If the booker cannot honor this booked stay due to one of the scenarios of force majeure presented below (effective on the date of the stay), he can cancel or postpone his stay. If the stay is postponed, the amount(s) paid will be kept until the new dates of the booked stay. If the stay is cancelled, the sum(s) paid will be returned to the customer within an appropriate time.

Scenario 1 : Critical illiness with medical proof attesting to the reservant’s inability to honour his or her stay.

Scenario 2 : Death of the reservate with proof of death

2/ COVID-19 cancellations : (cancellation fee of 50€ VAT included if application of the conditions below):

If the booker cannot travel during the booked stay due to one of the scenarios presented below (effective on the date of stay), he can cancel or postpone his stay. If the stay is postponed, the amount(s) paid will be kept until the new dates of the booked stay. If the stay is cancelled, the sum(s) paid will be returned to the customer within an appropriate time.

Scenario 1 : The government of the reservator’s country prohibits all travel to France.

Scenario 2 : Travel restrictions (ordered by the French government in response to COVID 19) prevent the reservator from going to the place of his reservation.

Scenario 3 : Complete closure with access ban (prefectural order) or government decisions to close the ski lifts.

Scenario 4 : If there is a mandatory national and/or regional lockdown and a travel ban in France (ordered by the French governement in response to COVID 19).

Scenario 5 : If the agency is forced to cancel the reservation holder’s stay in the accomodation provided for external purposes, it will offer the latter accomodation of the same standing or offer him the reimbursement of the sum(s) paid.

Inventory

Upon arrival of the tenant, an inventory of fixtures of the accomodation (carried out beforehand by the agency Prestige Gestion) will be signed by the customer. The latter will have 24 hours from his arrival to make any complaint concerning the inventory. After this period, the rented goods will be considered free of damage when entering the premises. The rented apartment contains furniture, dishes, bedding in accordance with the description of the accomodation. The tenant must report any deterioration or breakage occuring during his stay. He assures that he will return the accomodation upon departure in a state of correct cleanliness, despite the end of stay cleaning included when booking ; dishes made and bins emptied. Any additional hour of cleaning due to an unacceptable state of cleanliness of the accomodation may be charged extra (40€ VAT not included per hour).

The deposit

The deposit, the amount of which is indicated in the contract, will be paid at the entrance to the premises by bank imprint. It will be cancelled maximum one week after departure minus the cost of restoration of the premises. Any furniture and movable objects must suffer only from depreciation resulting from the normal use for which they are intended. The security deposit is paid to answer for any damage caused to the rented property. If the security deposit is not sufficient to cover the costs due to damage, the tenant commits to compensate the additional costs upon our first request.

Obligations

The tenant is required to comply with the regulations of the district in particular for noise pollution, respect of the common areas and the garbage room.

INSURANCE

The tenant will be required to insure himself against damages that may engage his liability. The tenant will thus be required to provide a holiday certificate, when booking, to confirm that he is guaranteed for damages that may occur during his stay.

LITIGATION

Any dispute over the execution of these terms and conditions will be the responsibility of the competent courts.

PETS

If they are allowed (subject to acceptance by the owner) only pets will be accepted by the owner.
